1. Introduction
Dwellspring (”App”) is owned and operated by Dwellspring, LLC (“Company”, “we”, “our”, or “us”). By downloading, installing, or using the App, you agree to comply with and be bound by these Terms & Conditions (“Terms”). If you do not agree with these Terms, please do not use the App.
2. License
We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
3. User Accounts
To access certain features of the App, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Prohibited Conduct
You agree not to:
- Use the App for any illegal or unauthorized purpose.
- Interfere with or disrupt the operation of the App.
- Transmit any viruses, worms, or harmful code.
- Attempt to gain unauthorized access to any part of the App.
- Use the App to harass, abuse, or harm another person.
5. Content
You are solely responsible for any content you submit, post, or display on the App (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content in connection with the operation of the App.
6. Content Ownership
By uploading content to the App, including but not limited to text, images, and videos, you acknowledge and agree that all such content (“Uploaded Content”) becomes the property of Dwellspring, LLC. This includes any content published on the “Creator Exchange,” a platform feature allowing users to share their creations with the community.
Even if you delete your account, Dwellspring retains the right to continue using, reproducing, modifying, and distributing your Uploaded Content on the App and the Creator Exchange. You waive any rights to compensation or acknowledgment for such use of your Uploaded Content.
7. Intellectual Property
All intellectual property rights in the App, including but not limited to text, graphics, logos, and software, are owned by us or our licensors. You may not use our intellectual property without our prior written consent.
8. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
9. Termination
We may terminate or suspend your access to the App at any time, with or without cause or notice. Upon termination, your right to use the App will immediately cease.
10. Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We disclaim all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of law principles.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the “Last Updated” date at the top of these Terms. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
